Welcome to Elmly. By placing an order with us, you agree to the following terms. Please read them carefully.
1. Eligibility
You must be at least 18 years of age to place an order through this website. By using this site, you confirm that you meet this requirement.
2. Prohibited Use
This site may not be used for fraudulent orders, unauthorized reselling, or any unlawful purpose. Elmly reserves the right to cancel orders and suspend accounts that violate these terms.
3. Order Acceptance & Fulfillment
All orders are subject to stock availability at our Canadian fulfillment centers. Placing an order does not guarantee fulfillment if an item becomes unavailable. If we are unable to fulfill your order, we will notify you promptly and issue a full refund — no questions asked.
4. Shipping & Delivery
We offer standard flat-rate shipping of $10.00 CAD on all Canadian orders, with free standard shipping on orders over $75.00 CAD. Orders are fulfilled and shipped by our trusted third-party fulfillment partner based in Canada, using major Canadian carriers (Canpar, Purolator, FedEx). Standard delivery times are 3–7 business days after processing. Please ensure your shipping address is accurate at checkout. Redirection or address correction fees may apply for errors provided by the customer.
5. Returns & Refunds
If we sent the wrong item or it arrived damaged or defective, we'll make it right at no cost to you — just contact us within 30 days of delivery. For ordering errors, items must be in their original, unopened packaging and are subject to a restocking fee. Please refer to our Refund Policy for full details, including timelines.
6. Pricing & Accuracy
Prices are subject to change based on manufacturer updates. In the event of a technical pricing error on our site, we reserve the right to cancel the affected order and issue a full refund. We will always communicate transparently if this occurs.
7. Product Use & Liability
Product warranties are provided by the original manufacturer. Elmly is a curated retailer and is not liable for indirect or consequential damages resulting from product use. Please follow all manufacturer instructions and safety guidelines included with your product.
8. Third-Party Fulfillment
Elmly partners with a third-party fulfillment provider based in Canada to process and ship your orders. Your shipping information (name, address) is shared solely for the purpose of completing your delivery. Your data is never used for direct marketing or shared with third-party advertisers. 9. Product Imagery Disclaimer
Product images, including packaging, are for illustrative purposes only. Actual packaging may differ from what is shown due to manufacturer updates, seasonal designs, or limited-edition releases. The product contents and quality remain consistent regardless of packaging appearance. Elmly sources all products directly through authorized distributors to ensure authenticity.
10. Dispute Resolution
If you have a concern about an order, we ask that you contact us directly before initiating a chargeback with your financial institution. Most issues can be resolved quickly through our support portal. Elmly reserves the right to contest chargebacks where the underlying claim does not meet our published return and refund criteria, and to provide evidence of order fulfillment to the relevant financial institution.

Elmly reserves the right to update or modify these Terms of Service at any time without prior notice. Changes take effect immediately upon posting to this page. Your continued use of this website or placement of an order following any update constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
12. Governing Law
These Terms of Service and any dispute or claim arising from your use of this website or any purchase made through it shall be governed by the federal laws of Canada. Any disputes shall be subject to the jurisdiction of the courts of the Province of Ontario.
